Professional Indemnity (PI) Insurance
PI provides protection against claims of alleged negligence or breach of duty arising from an act, error or omission in the performance of professional advice or service and covers the costs for your legal defence and any damages you may have to pay.
For some professions in Australia, it is a legal requirement to hold PI insurance, or it may be a mandatory part of a professional licence or membership in an industry association. It can also be a contractual requirement.
It is always best to check with your relevant industry body to determine if PI cover is a legal requirement and/or if a minimum level of cover is required.
Professionals who require PI can include:
- Accountants
- Architects
- Consultants
- Engineers
- Estate agents
- Legal counsel
- Recruitment companies.
PI insurance can cover you for unexpected costs including:
- Claims relating to professional services provided by your consultants, contractors, sub-contractors or agents
- Claims investigation costs
- Public and products liability
- Public relations consultants
- Estates and legal representatives.
What is typically not covered with a PI policy?
- Intentional damage or misconduct
- Contractual liabilities
- Professional fees refunds
- Known claims and circumstances that may have occurred prior to the period of insurance
- Acts of fraud and dishonesty
- Accidental injury and property damage (these kinds of claims would typically be covered by Public Liability insurance).
